What is the Employee Retention Tax Credit?

The CARES Act became law in March of 2020. It included the Employee Retention Tax Credit which is managed by the IRS. It is sometimes referred to as the ERC or ERTC program.

This initiative by Congress refunds, on a quarterly basis a percentage of the payroll for W-2 employees that a company paid. There are meticulous rules for determining how much credit can be claimed for each employee.

Who is eligible for the ERTC?

Every small business may apply for the Employee Retention Tax Credit. However, every business may NOT be eligible. A business may be eligible if: their revenues declined; they were affected by a government ordered closure (either partial or complete); capacity restrictions; supply chain issues. There are a total of 16 different ways that a business may qualify for eligibility to get Employee Earned Tax Credits.

I got the PPP am I eligible for the ERTC?

In March 2021, The American Rescue Plan Act of 2021 was signed into law. It modified and expanded The CARES Act. The verbiage is very clear. Businesses that had already received or had applied for PPP funds could qualify for the Employee Retention Tax Credits. Businesses have until December 2023 to retroactively claim refunds.

Is the Employee Retention Tax Credit (ERTC) a loan?

The ERC / ERTC is NOT a loan. The ERC / ERTC is NOT a grant. Businesses that qualify for the ERC / ERTC will not have to pay it back.

How long will it take to get my Employee Retention Credit?

My business was not open in 2019. Can I still apply?

ABSOLUTELY. If your business started after February 15, 2020, you may still be eligible for an ERC / ERTC refund. This is because there is a provision for Recovery Startup Businesses (RSB) to receive Employee Earned Tax Credits.
